Timelines vary widely, and we cannot predict one before we review your file. A straightforward claim with clear liability may resolve within a few months after you finish treatment. Cases involving serious injuries, disputed fault, several insurers, or litigation often run longer.

Passengers are usually able to pursue a claim because they rarely share fault for a crash. Your claim may run against the driver of the car you were riding in, the other driver, or both, depending on who caused the collision. What you actually recover still depends on the injuries you can document and the coverage available to each driver.

This is a hit-and-run. Report it to the police and to your own insurer quickly, because many policies set short reporting deadlines for these claims. Write down everything you remember about the vehicle and look for nearby cameras that may have recorded the crash. Uninsured motorist coverage may apply if police never identify the driver, though any payment depends on your policy terms, your limits, and the proof you provide.

A denial does not always end a claim. Ask the insurer to put the reason in writing, then have a lawyer read the policy and review the file. Depending on the reason and the type of coverage, the next step may be a request for reconsideration, a supplemental demand backed by additional medical proof, arbitration under the policy, a complaint to the California Department of Insurance, or a lawsuit.

Some providers agree to treat injured patients on a medical lien, which means they wait for payment until the case resolves. Lien treatment is not available for every provider, every injury, or every case, and a lien is a debt that comes out of any recovery. Health insurance and medical payments coverage on your own auto policy may also pay for care, so we look at every source before we recommend a path.

You are not required to give the other driver's insurer a recorded statement. If a lawyer already represents you, give the adjuster your attorney's name and end the call. If you do not have a lawyer yet, you can decline the recorded statement and get advice first, because insurers often use early statements to dispute injuries or shift blame.

Lost income is a recoverable part of many injury claims. You will need proof, such as pay stubs, tax returns, and a doctor's note tying your time off work to the crash. Self-employed people can use invoices, contracts, and prior returns to show what they lost. What you recover still depends on liability and on the coverage available.

Uninsured motorist coverage on your own policy may pay for your injuries when the at-fault driver carries none. Payment is not automatic, because your insurer can dispute fault, question your injuries, and apply policy limits, exclusions, and offsets for other benefits you received.
